1. Definition and Interpretation
    • Hexa Application - Service & Asset Utility or Hexa is a mobile application that helps to connect workspace and utility service providers and those who need workspace and utility services. Hexa, operated by GEEK Up Technology Joint Stock Company, is to book and use services at GEEK Hub - Workspace & Cafeteria.
    • Company means GEEK Up Technology Joint Stock Company.
    • Services are workspace and utility services.
    • Customers are individuals and organizations requesting to use workspace & utility service at GEEK Hub using Hexa to submit service requests.
    • Users are individuals and organizations registered to use Hexa Application.
    • Intellectual Property is any patent, copyright, registered or unregistered design, rights to the design, registered or unregistered trademarks, service marks or public ownership, industrial or other intellectual property, including applications to any of the above.
  2. General provisions

    • Users are individuals, organizations, using Hexa and having demand for workspace and utility services of GEEK Hub - Workspace & Cafeteria. Users must register in accordance with legal regulations and be recognized by the Management of GEEK Up Technology Joint Stock Company.
    • By accessing to Hexa and making request for Services, Users have already agreed to comply with and be bound by the regulations, terms and conditions herein on Hexa operations.
    • Upon taking part in Hexa, Users must learn about their legal responsibilities under Vietnam’s current laws by themselves and commit to their responsibilities in the Regulation, terms and conditions herein of Hexa.
  3. User Account Policy
    1. Customers are required to provide accurate information.
    2. Each Customer can create only one (1) account associated with one (1) phone number for personal use.
    3. Customers are required not to share the account credentials (username and password), give access to Hexa account, or transfer the Hexa account to anyone else without the Company’s permission.
    4. Customers can not use Hexa if the account was previously disabled due to violations of the terms and condition herein.
    5. Customers can only log in one (01) device at a time.
    6. The Company reserves the right to block or deny access to Hexa accounts or to block features available in Hexa, without prejudice to its other rights and remedies:

      • if the Company deems, in its sole discretion, that there are violations of any term of these terms and condition herein;
      • during an investigation, or suspected fraudulent actions
      • if these Terms of Use are terminated for any reason; or
      • at any other time in the Company's reasonable discretion.
    7. Blocked accounts could only be reactivated after proper verification or at the discretion of the Company.
  4. Policies of cancellation & refund
    1. Policy of canceling orders: Orders on Hexa can not be canceled after the workspace or utility request has already been delivered to the Customer. Customers can cancel service requests via Hexa only when the request status is under "Waiting to confirm" status (which is prior to "Confirmed" status (in either English or Vietnamese).
    2. For cancellation support, customers can contact Customer Service via phone number 028.2200.8683 or send email to geekhub.vn@gmail.com. The Customer Service will check the request status after receiving the cancellation request. If the order has not been prepared by GEEK Hub - Workspace & Cafeteria, Customer Service can cancel the order; Orders prepared by GEEK Hub - Workspace & Cafeteria can not be canceled.
    3. Policy of refunds:

      • All services and utilities provided on Hexa are non-refundable once the Customer has started using the services or received the utilities, unless the services and utilities provided are not the same as requested by the Customer. For services and utilities provided without adequate quality, Company will support at its best effort as set out in the "Handling complaint".

  5. Complaint handling procedures
    • Step 1: Receive complaints
      • Users can send their comments or complaints in the following ways:

    • Step 2: Processing
    • Within 24 hours (excluding holidays) from receiving, the Management of Hexa will process the complaint.
    • Step 3: Reply to Customer
    • The management of Hexa will deliver the response to Customers via mail, telephone, or email. If the complaint is complicated and requires more time to resolve and respond to the Customer clearly, Hexa will contact the Customer to extend the response time.
  6. Payment methods
    1. Cash and online payment methods (including Momo, Grab Pay by Moca, VNPay)
    2. Top-up with GEEK Hub: available on Hexa.
  7. Protection of User's Personal Information
    1. Purpose and scope of personal information collection that GEEK Up Technology Joint Stock Company collects personal information to:

      • Provide service requests from Users;
      • Understand how Users use the Services so that the Company can improve User’s experience;
      • Provide customized content and advertising;
      • Detect and prevent any fraudulent activities of third parties that may cause harm to User’s account or relating to User's use of the Service;
      • Carry out research, survey, analysis with respect to development and improvement of the Services, and create customer profiles; and
      • Submit to the State Agencies as required by the laws of Vietnam.
    2. When User Information is utilized for a purpose other than the above purposes, we shall seek your consent.

      • Field of use and time of storing information
      • All transaction information will be kept confidential but in case the legal authorities require, the Company will be obliged to provide the legal authorities with this information.
      • The information will be stored on the system of Hexa and operated at the office of GEEK Up Technology Joint Stock Company with the address above.
      • Customers can change, view or erase their information by signing in to Hexa or by sending an email to: geekhub.vn@gmail.com
  8. Information risk management
    1. Users will be responsible for the confidentiality and storage of all activities of using Services under their registered account.
    2. It is the responsibility of User to promptly notify the Company when detecting unauthorized use, abuse, privacy violation, storage of third party’s registered account to take suitable measures to resolve.
    3. Users must not use the Services of the Company for the illegal, unreasonable fraudulent, threatening, illegal poll, destructive, virus creation, and distribution purposes, causing damage to the Company’s system, configuration, and transmission of information.
    4. Users must not use Hexa for the purposes of speculation, creating fake orders, including works serving for evaluation of market demand. In case of violation, User must take responsibilities according to Vietnamese laws.
  9. Liability in case of technical failure
    1. When carrying out transactions on Hexa, Users are obliged to perform in accordance with instructions.
    2. The Company commits to providing the best quality Services for Users participating in transactions. In case of arising technical failures, software bugs or objective errors which may result in that User cannot participate in a transaction, User can notify the Company.
    3. Company will correct errors in the earliest time for making the condition for Users to use Hexa.
    4. However, Company will not be responsible for solving in case User’s notice does not reach the Company, arisen from technical error, transmission and software errors or other errors not caused by the Company.
  10. Rights and obligations of the Management of Hexa
    1. Rights of the management of Hexa

      1. The Company will provide Services to User after completing the required procedures and conditions stated by the Company;
      2. The Company reserves the right to change the terms and condition herein any time without prior notice;
      3. If User provides the Company with inaccurate, incomplete or information that violates the law or Vietnam’s fine customs, the Company has the right to refuse, suspend or terminate User's account;
      4. The Company can suspend or terminate User’s account in case User breaks the regulations of the Company or has an act of affecting business operation of the Company;
      5. In the event the account is terminated, all associated permissions will also be automatically invalid and terminated;
      6. All rights on the use of the services and contents on Hexa by the Company according to legal provisions on the protection of Intellectual Property in Vietnam. All logos, contents in different languages are under the ownership of the Company. All acts of copying, use and illegal dissemination of the copyrighted materials are strictly prohibited;
      7. Company reserves the right to change service prices and payment method during the time of providing services for Users in accordance with the Company’s needs, conditions and ability.
    2. Duties and Responsibilities of the Hexa Management Board

      • Company will facilitate the process of placing orders as soon as possible. However, the Company will not bear any liability for failure condition or time of inactive application
  11. User Rights and Responsibilities
    1. Right of Users

      1. User will have the right to sign in to use the Hexa application to order services & utilities without paying any other fees apart from fee for service & utilities service charge;
      2. Users have the right to send questions, suggestions or feedback to Hexa during the operations as per the above feedback process.
    2. Obligation of Users

      1. Provide full and accurate personal information: full name, email, phone number, address (district, province) and other information, and be responsible for the legality of the above information;
      2. User must absolutely not use any program, tool, or any other form to intervene in the system or alter data structures. It is strictly forbidden to distribute, disseminate or support any activities aiming at intervention, trespassing or destruction of the application system;
      3. User will be solely responsible for the privacy and storage of all service use activities under the registered account. It is User's responsibility to promptly notify the Company of unauthorized use, abuse, privacy violations and storage of account information;
      4. User undertakes not to use Hexa's Services for illegal purposes. Users are responsible for their actions according to the law.
  12. General Terms
    • The Company may amend these terms and conditions herein at its sole discretion from time to time. Company will use its reasonable endeavours to notify User of any material changes to the Terms of Use; however User agrees that it is User’s responsibility to review the terms and conditions herein regularly and User’s continued use of the Hexa application will constitute User’s acceptance to the amendments.
